Louis Lang achieves partial victory in the Fourth Circuit

Callison Tighe partner Louis Lang, along with co-counsel Cullen Macbeth of the Federal Public Defender’s office for the District of Maryland, recently won a partial victory for their client in the U.S. Court of Appeals for the Fourth Circuit.
In United States v. Canada, 103 F.4th 257 (4th Cir. 2024), decided last month, the Fourth Circuit rejected Mr. Canada’s Second Amendment challenge to the constitutionality of a federal law prohibiting felons from having firearms. The Court, however, vacated Mr. Canada’s 220-month prison sentence, sending the case back to the district court for resentencing.
The court ruled that Mr. Canada was incorrectly sentenced under the Armed Career Criminal Act, which mandates a minimum sentence of 15 years imprisonment. On resentencing, Mr. Canada will no longer face that 15-year mandatory minimum sentence.
